Terms of Service

Please read these terms carefully before using our services. They govern your relationship with CareDevi.

1. Acceptance of Terms

By accessing or using CareDevi, you agree to be bound by these Terms of Service.

  • These Terms constitute a legally binding agreement between you and CareDevi Inc.
  • By creating an account, downloading, or using the app, you acknowledge that you have read, understood, and agree to these Terms
  • If you do not agree to these Terms, you must not use the app
  • You must be at least 18 years old to create an account and use our services

2. User Accounts & Security

You are responsible for maintaining the security of your account credentials.

  • You must provide accurate, current, and complete information during registration
  • You are solely responsible for all activity that occurs under your account
  • You must not share your login credentials or allow others to access your account
  • Notify us immediately at support@caredevi.com if you suspect unauthorized access
  • We reserve the right to suspend or terminate accounts that violate these Terms
  • One account per individual — creating multiple accounts is prohibited

3. Acceptable Use

You agree to use CareDevi only for lawful purposes and in accordance with these Terms.

  • Do not use the app to transmit harmful, fraudulent, or misleading content
  • Do not attempt to gain unauthorized access to other users' data or our systems
  • Do not reverse-engineer, decompile, or disassemble any part of the application
  • Do not use automated systems (bots, scrapers) to access the app without our written consent
  • Do not harass, abuse, or send threatening messages to other users through challenge interactions
  • Violations may result in immediate account suspension or termination

4. Health & Wellness Data

Your health data is handled in accordance with our Privacy Policy and applicable laws.

  • Health data is collected only with your explicit consent and processed per our Privacy Policy
  • Data from Apple HealthKit and Google Health Connect is used solely to display wellness insights within the app
  • We comply with HIPAA requirements for the storage and handling of protected health information (PHI)
  • You may revoke health data access at any time through the app or your device settings
  • We do not sell, license, or otherwise commercialize your health data

5. Medical Disclaimer

IMPORTANT: CareDevi is not a medical device and does not provide medical advice.

  • The app provides wellness and fitness information for general informational purposes only
  • Nothing in this app constitutes medical advice, diagnosis, or treatment
  • Health metrics (heart rate, sleep, steps) are estimates and should not be relied upon for medical decisions
  • Always consult a qualified healthcare professional before making health-related decisions
  • In case of a medical emergency, call 911 or your local emergency services immediately
  • CareDevi assumes no liability for health decisions made based on information displayed in the app

6. Intellectual Property

All content and intellectual property in CareDevi is owned by CareDevi Inc.

  • The app, including its design, code, graphics, logos, and content, is protected by copyright and trademark laws
  • You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes
  • You may not copy, modify, distribute, or create derivative works of any part of the app
  • User-generated content (e.g., profile photos, challenge posts) remains yours, but you grant us a license to display it within the app

7. Limitation of Liability

To the maximum extent permitted by law, CareDevi Inc. limits its liability as follows:

  • The app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
  • We do not guarantee the accuracy, completeness, or reliability of health data or wellness insights
  • In no event shall CareDevi Inc. be liable for indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater
  • Some jurisdictions do not allow limitations on implied warranties or liability; these limitations apply only to the extent permitted by law

8. Dispute Resolution

Any disputes arising from these Terms shall be resolved as follows:

  • You agree to first attempt to resolve any dispute informally by contacting legal@caredevi.com
  • If informal resolution fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA)
  • Arbitration shall take place in the State of [Your State], and the arbitrator's decision shall be final and binding
  • You waive the right to participate in class action lawsuits or class-wide arbitration
  • Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property violations

9. Termination

Either party may terminate this agreement at any time.

  • You may delete your account at any time through the app's Settings > Data & Privacy screen
  • We may suspend or terminate your access if you violate these Terms or engage in prohibited conduct
  • Upon termination, your right to use the app ceases immediately
  • Sections relating to intellectual property, limitation of liability, dispute resolution, and indemnification survive termination

10. Changes to Terms

We reserve the right to modify these Terms at any time.

  • Material changes will be communicated via in-app notification or email at least 30 days before taking effect
  • The "Last Updated" date at the bottom of this page indicates the most recent revision
  • Continued use of the app after changes take effect constitutes your acceptance of the revised Terms
  • If you disagree with any changes, you must discontinue use and delete your account
